1. Under the freedom of information act, a copy of the photograph you took of the opening during your site visit for the Planning Application 212778.
See attached file. We can confirm that we do hold the information requested however the request to provide it is refused under the following exceptions;

Paragraph 12;

• Section 4 (e) the information held is part of an internal communication

• Section 5 (f) (parts i, ii & iii) the interests of the person who provided the information where that person—
(i) was not under, and could not have been put under, any legal obligation to supply it to that or any other public authority;
(ii) did not supply it in circumstances such that that or any other public authority is entitled apart from these Regulations to disclose it; and
(iii) has not consented to its disclosure

These exceptions carry with them a public interest test and provision or refusal to supply the information has been determined on the basis that public confidence in cooperating with the Local Authority would be irrevocably harmed if we supplied data collected in confidence to a third party; the neighbour in this case had a reasonable expectation of confidentiality when we recorded the photographs in their private home and that this information will not be shared without their express consent. The public interest therefore in not disclosing the information outweighs the public interest in disclosing it in this case.
