Please provide the following information regarding the yellow lines recently painted at the junction of Crutchley Road and Wiltshire Road:
1. When was the notice posted on the Wokingham Borough Council website as required under the Road Traffic Regulation Act 1984 giving 28 days’ notice of their intention to carry our such work? Did it state exactly (as is required) what work was to be carried out together with the exact location? ie. metres from the Crutchley Road junction/connection to existing yellow lines.
The dates affecting the Notice of Making for the Traffic Regulation Order under which the restrictions in Wiltshire Road have been installed are attached. Notices were simultaneously displayed on the Council’s website for the same periods and on site for the duration of the Statutory Objection period. As an order making authority Wokingham Borough Council, before making an Order publishes at least one notice (a “notice of proposals”) containing the particulars specified in Parts I and II of Schedule 1 of the Local Authorities Traffic Orders (Procedure) (England & Wales) Regulations 1996, in a newspaper circulating in the area in which any road or other place to which the order relates is situated.
The Council also takes other steps, in so far as it considers it appropriate, to ensure that adequate publicity about the Order is given to persons likely to be adversely affected by its provisions. The Council also sends a copy of the Notice of Proposals to each body or person whom it is required to consult under Regulation 6(1) or under any of the provisions referred to in regulation 6(2) and (other than during the COVID pandemic) complies with the requirements of Schedule 2 as to the making of deposited documents available for public inspection.
2. The names and dates of the publication(s) where such notice was inserted.
As shown in the attached documents.
3. The reason why the Statutory Notice period was not complied with in posting the notice on the lamp-posts which also failed to specify (as required) what works were to be carried out.
Notices were simultaneously displayed on the Council’s website for the same periods as those advertised in local press and on site for the duration of the Statutory Objection period.
