“Follow on request from WBCIR:15961
1. Please provide a copy of the full advice received from Microsoft that customers relinquish certain perpetual rights when they move to O365.
This advice was received from our 3rd party supplier not Microsoft direct. "Microsoft have claimed that customers relinquish certain perpetual rights when they move to O365"
We now request that you provide:
1. The document in which this advice was contained.
2. Any further advice the Council received regarding certain perpetual rights in its licences when it moves to O365.
Under s.3(2) of FOIA, a public authority is obliged to provide information that it either holds or is held on its behalf. As a matter of law, information is held on a public authority’s behalf if it has a contractual right to view that information. It may be that the council needs to ask its 3rd party supplier to obtain the answer to question 2.
