If it is not possible to identify specific case costs then please provide the contract charging model for claims handling for highway defects.

The Council are not able to provide this information. We have spoken with the regional director at our insurers who has in turn referred it on to the compliance team at Gallagher Bassett.

Disclosure of this fee information would give Gallagher Bassett’s competitors confidential information about their fees which are viewed as commercially sensitive, by reference to statutory exemption section 43(2) in that disclosure would, or would be likely to, prejudice Gallagher Bassett’s commercial interests. For this reason, we believe the cost of the fee to deal with the claim, and the charging model, should not be released. The Council have no reason to overall their guidance on this matter.
