Delegated Agreement Matters

1. A copy of the relevant delegated agreement in respect of planning applications determined by the council. This shall include all relevant standing orders, internal guidance and published standards, and advice on how and when a councillor can request a committee decision rather than a delegated decision.

2. Copies of all correspondence with any councillor seeking to refer planning application reference 231166 (regarding Silvaplana, High Street Wargrave) in respect of such a referral

3. Copies of all written advice, or notes of verbal advice, given by senior officers from any department in the Council on the referral of this application for a committee decision, specifically any advice from senior planning officers or members of the Chief Executives office or Committee Secretariat, legal services or their equivalents.

4. In the absence of such information confirmation that the officer dealing with the application made the decision to determine the application under delegated powers himself.

5. Details of all planning applications since January 2020 determined after referral to the planning committee which would normally have been of a scale capable of being determined under delegated powers. In each case were these a consequence of a request by a councillor, applicant, objector or parish council.

Tree Preservation Order Matters

6. Copies of all tree preservation order prosecution reports undertaken in respect of the application site

7. Copies of all tree replacement notices in respect of the same site

8. Copies of all subsequent correspondence with the land owner regarding the replacement notice

9. Copies of all internal correspondence, including file notes of verbal discussions, in respect of securing the requirements of any tree replacement notice expressly including any advice given by the council as part of pre application or post application correspondence on this matter with the Owner. Applications in this respect refer to the following: 172104 (withdrawn 21/9/17), 181617 (refused 4/7/18), 192252 (refused 17/11/19), and 231166 (approved 26/7/25)

Demolition of High Street Wall Matters

10. Following the car crash of 2/5/20, copies of all correspondence with the Owner or his representatives in respect of the removal of the wall in its entirety. This shall include all structural reports submitted by or on behalf of the Owner, all structural reports or other assessments undertaken by or on behalf of the council, and all agreements made with the Owner in respect of the demolition of the wall. The council in this respect refers to officers within any department, including planning, conservation, highways, building control and/or environmental health.

11. Copies of any Urgent Works Notice made in respect of the demolished wall

12. Copies of any correspondence with the Owner or within the council that in respect of the demolition of the wall, refers to the planning application and listed building consent in respect to repairs to the wall ref 162255/6 (approved 10/10/16). This is the application and report that explains the significance of the wall and the desirability of refurbishment and repair.

Pre Application Advice Matters

13. Copies in full of all correspondence, written and /or recorded by file note, in respect of pre application discussion(s) with or on behalf of the Owner following the appeal decision in respect of application 192252.

Comparison Drawings Matters

14. Copies of all correspondence with or on behalf of the applicant written and/or recorded by file note, in respect of the comparative drawings provided by Mr Peter Williams, received by the Council in his objection by email on 21/2/24.

15. Copies of all reports, internal emails and other correspondence, and officer assessment of the accuracy, relevance and weight as a material consideration in respect of these comparison drawings.

16. Copies of any referral to senior officers on the issue of these comparison drawings specifically in respect of senior officers within the planning department, within legal services and within the Chief Executives office.

Other Matters

17. Copies of any advice provided by legal services, whether prepared by officers within the council or external advisers, with regard to the handling and determination of the application ref 231166.
