Statutory declarations

We have an obligation to keep a register of any map and statement and any statutory declaration given to us by landowners under section 31-6 of the Highways Act 1980 relating to dedicated highways.

These statements and declarations enable landowners to acknowledge the public rights of way across their land and, in doing so, create a presumption that they have no intention to create any further routes across their land. This evidence is examined whenever a new right of way is claimed.
