Commercial waste and recycling
Anyone who produces, carries, disposes or otherwise holds any household, commercial or industrial waste has a duty to:
- Prevent the waste escaping from where it is stored
- Prevent anyone disposing of it unlawfully
- Ensure it is transferred to a licensed site
- Ensure it is collected by a registered waste carrier
- Ensure that proof of disposal Waste Transfer Notes are retained for inspection after being provided by your collector or from a licensed disposal outlet
The Council has a statutory duty under the Environmental Protection Act 1990 to collect and dispose of commercial waste if requested to do so. The charge the Council would levy per emptying of an 1100 litre bin would be £19.30 which includes collection administartion bin hire and disposal.
Environment Agency advice - commercial waste disposal
There are new rules for non‑hazardous wastes which apply in England and Wales. After 30 October 2007, non‑hazardous waste landfills will not be allowed to accept liquid or untreated waste.

Businesses will either need to treat their own waste or ensure it is treated by someone else before it can go to landfill. Many businesses already treat their waste in a simple way such as collecting waste streams separately and recycling one or more of the separated parts.

The new rules
The new rules have been talked about in the trade press and on industry web sites and many waste management companies have been talking to their customers about pre-treating their waste.

Failure to comply with your duty under the above act could result in a fine of up to £50,000 at magistrates court. More serious cases can be heard at crown court and carry unlimited fines.
Waste collection and disposal is not included in your annual Business Rates.
