Headteachers and teachers, and other staff given authority to do so by the headteacher, are empowered by the 1996 Education Act to use reasonable force in appropriate circumstances. That duty needs to be applied in the context of the duty towards child welfare under the Children Act and 2002 Education Act, and be consistent with the 1998 Human Rights Act. This guidance takes account of this legislation and closely follows the national guidance to schools published by the DfES, and DoH advice.
Recent research by NfER into the impact of the DfES guidance saw this as being of value to all schools, to improve staff confidence and competence in the management of challenging behaviour. As well as dealing with aspects of physical intervention, including restraint, the guidance also looks at prevention and de-escalation strategies and risk assessment.
