How to carry out work to a protected tree
You, or your contractor, should check whether or not a tree is protected before starting any work, as pruning or felling a protected tree can result in prosecution. Applications to undertake work to protected trees can be made through The Planning Portal. We will respond to your request within 8 weeks. If we turn down your request to carry out work, you can appeal to the Planning Inspectorate. Find out more about Tree Preservation Order Appeals on the Planning Portal website.
Trees covered by Planning Conditions
Many Planning Permissions for new houses or extensions contain Conditions which protect trees and hedges. If you plan to carry out work to a protected tree/hedge you must complete an application for removal or variation of a condition and forward it, with the appropriate fee, to us. Please state clearly the work you propose and the reason/s for it and enclose a sketch plan of your property showing the position of the relevant tree/hedge. If a tree is to be removed, you should plant a replacement, so it would be useful to mention any replanting proposals in the same letter. Please include quantity, size and species wherever possible. Contact our Development Management team for advice on planning permissions.
