Development Plan Policies saved beyond 28 September 2007

Under Schedule 8 of the Planning and Compulsoury Purchase Act 2004, those parts of the Development Plan which were adopted before 28 September 2004 will only stay in effect until 28 September 2007, unless the Secretary of State issues a Direction to the contrary.  Since the Wokingham District Local Plan, Replacement Berkshire Minerals Local Plan and Berkshire Waste Local Plan were all adopted before 28 September 2004, the Council must request that the Secretary of State issues a direction to save these existing plans until they are replaced through the Local Development Framework. Any request must be submitted at least 6 months before the Development Plans ceases to be saved i.e. the request should be in before 28 March 2007. This request was agreed at the Executive and Council meetings on 25 January 2007.

 

The Council on 25 September received the response of the Secretary of State to its request to save policies. A copy of the Secretary of State's decision is attached below, together with the reasoning submitted by the authority.

 

The authority at the meeting of the Executive on 28 November 2007 considered which policies of the Berkshire Structure Plan it would suggest that the Regional Assembly requests the Secretary of State saves beyond 15 July 2008. The table detailing the reasons for its suggestions is attached. The Council received the response of the Secretary of State on 26 June 2008.
