Freedom of Information

The Freedom of Information Act - FOIA - 2000 requires all public authorities to be open with information. It gives a general right of access to all types of recorded information we hold, sets out exemptions from that right and places various obligations on us.

It also means that we must:

  • Maintain a Publication Scheme

  • Inform anyone who makes a request to us for information whether we hold that information and supply the information unless there is an exemption for that particular information

How do I request information?

Requests must be in writing. You can use our online Freedom of Information Request Form. You will receive an acknowledgement within 5 working days and we will reply to your request within 20 working days. You should:

  • Make the information as specific as possible. If your request is too broad we may ask you to clarify it. This could mean it takes longer to get the information.

  • Provide as full a description as possible of the information you require

  • Supply your name and an address for us to reply to you at

  • Be clear about the format you would prefer to receive the information in, for example, by email or as a paper copy

 

How much does it cost?

Most information is free of charge but some publications have a cover charge. We also charge for photocopies of documents. Where there is a fee or the cost of meeting your request is more than the legal limit - currently £450 - we will tell you in advance so that you can decide whether you want to go ahead with your request. Information can't be provided until the fee is paid.

How to make a Freedom of Information Request

Although Freedom of Information requests must be in writing, we can make reasonable adjustments to help you if you have a disability that prevents you from making your request in writing.

Can the council withhold any information or decline my request?

Yes. Wherever possible, we will provide you with the information you have requested. However, we do not have to confirm or deny the existence of the information or provide it, if:

  • An exemption, specified by the FOIA - Freedom of Information Act, applies

  • The request is malicious or similar to a previous request, or

  • The cost of compliance exceeds an appropriate limit
