Environmental Information Regulations

The Environmental Information Regulations 2004 - EIR - give you a right of access to a wide range of environmental information held by us.

What is environmental information?

Environmental information includes information about: air, water, soil, land, flora and fauna, energy, noise, waste and emissions. It also includes:

  • Any decisions, measures and activities affecting or likely to affect any of the above
  • Financial and cost benefit analysis relating to the above
  • Certain information about human health and the food chain, built structures and cultural sites

 

How do I request environmental information?

You can email us or call us. We will reply to your request within 20 working days.

How much does it cost?

We make charges provided they are reasonable for supplying information under EIR.

How to request environmental information

Use the online Environmental Information Request Form or contact us.

Can the council withhold any information or decline my request?

Yes. Wherever possible, we will provide you with the information you have requested. All information under the EIRs is subject to the public interest test. This means that we judge whether it serves the interests of the public to disclose or withhold the information.

A request for information can be refused if: 

  • The information is not held
  • The request is unreasonable
  • The request is too general
  • The request is for unfinished documents/data
  • The request is for internal communications

 We can also refuse to release information in order to protect: 

  • The confidentiality of proceedings
  • International relations/public security/defence
  • The course of justice and right to a fair trial
  • Commercial confidentiality
  • Intellectual property rights
  • Personal/voluntary data
  • The environment
