Smoke free

Since 1 July 2007 all indoor public places and workplaces in England are smoke free. All businesses are affected by these new laws. The law has been introduced to protect employees and members of the public from the harmful effects of second hand smoke.

Advice

An advice line has been launched for people wanting to know more about the law.  The number to call is 0800 169 1697.

Smokefree website has also been set up for businesses and members of the public wanting to know more. From this website you will be able to register for updates and download leaflets and information about the new requirements and how they affect you. In addition, the signage required under the new legislation can be obtained from this website.

If you are thinking about putting up a shelter outside you may need to apply for planning permission. You can find out more about planning information in our planning information pages. Information on what is acceptable in the new legislation regarding smoking shelters can be found on the Smokefree website.

You should consider other issues that will be involved with people smoking outside of the premises, for example:

  • Increased noise and litter
  • A change in conditions of your Premises License - if you have regulated entertainment - our Licensing Team can advice you if necessary.
